According to the Government Instruction of 10 March 2022, Ukrainians coming to Europe are to gain access to temporary protection. Temporary protection allows them to work, receive care, have access to housing and education. The conditions of temporary protection are listed on Amnesty International France web site.

The ministerial circular of 23 March 2022, available here, specifies the conditions for the reception of students displaced from Ukraine and completes the temporary protection scheme for Ukrainians.

Students with temporary protection will be hosted in higher education institutions. (see section Reception of Ukrainian academic and student refugees)

In this respect, it is important to remember that temporary protection is offered to students from Ukraine if :

  • Case #1: he/she is a Ukrainian national and was residing in Ukraine before 24 February 2022;
  • Case #2: he/she is not a Ukrainian national and he/she benefits from a protection (international or national equivalent) granted by the Ukrainian authorities;
  • Case #3: he/she is not a citizen of Ukraine but has a valid permanent residence permit issued by the Ukrainian authorities and is not able to return to his/her country of origin;
  • Case #4: he/she is a family member of a person falling under one of the previous cases (family members are: spouse, unmarried minor children and dependent parents).

In order to benefit from this temporary protection, the foreign national who meets the conditions of one of the four cases mentioned above must go to the “prefecture” of the department where he/she lives or is staying. If his/her application is complete and admissible, he/she will then obtain a temporary residence permit for a period of six months, marked “beneficiary of temporary protection”.

The Ministry of Interior announced on March 1, 2022 that residence permits of Ukrainians residing in France were “automatically” prolonged by 90 days.
